Article 1. Purpose
The purpose of this document is to define the general conditions of access and use of the EagleYard Training platform, an online training and community platform dedicated to EagleYard staff.

Article 3. Conditions of access and registration
Access to the platform is reserved for Users with an Account. To create an Account, the User must provide accurate, complete, and up-to-date information, and choose a confidential and personal login and password. The User is responsible for the security and use of his/her Account, and undertakes not to assign, lend, or transfer it to a third party. In the event of loss, theft or usurpation of his/her login or password, the User must immediately inform the Platform Administrator by e-mail to admin@eagleyardtraining.com.
Article 4. Use of Services and Content
The User undertakes to use the Platform in compliance with the laws and regulations in force, as well as the rights of third parties and public order. In particular, the User agrees not to:
The platform reserves the right to moderate, delete, suspend, or block any Account, Service or Content that does not comply with these terms of use, without notice or compensation.
Article 5. Intellectual property rights
The Platform is the exclusive property of EagleYard, which holds all related intellectual property rights. The User acknowledges that the Platform, the Services, and the Content are protected by copyright, trademark law, patent law, database law or any other intellectual property right.
The User undertakes to respect these rights and not to reproduce, copy, modify, adapt, translate, distribute, disseminate, or exploit the platform, the Services, or the Content without the express written authorization of the platform or the holders of the rights.
The User retains ownership of the Content he/she creates, shares, or uploads to the platform, subject to respect for the rights of third parties.
The User grants the platform a non-exclusive, free, worldwide license, for the entire duration of legal protection, to use, reproduce, represent, modify, adapt, translate, distribute, and disseminate the Content, on any medium and by any means, as part of the operation and promotion of the platform.
Article 6. Protection of personal data
The Platform collects and processes Users’ personal data in compliance with Law no. 2013-450 of June 20, 2013, on the protection of personal data and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals about the processing of personal data and on the free movement of such data. The platform undertakes to ensure the security, confidentiality, and integrity of Users’ personal data, and not to communicate it to third parties without their consent. The platform uses Users’ personal data for the following purposes:

Article 7. Liability and warranty
The platform endeavours to provide a high-quality, reliable, secure service that is always accessible. However, the platform cannot guarantee the accuracy, completeness, timeliness or relevance of the Services or Content, nor the absence of errors, bugs, viruses, or platform malfunctions. The platform may not be held liable for direct or indirect damage, material or immaterial, caused to the User or to third parties because of the use or impossibility of use of the platform, Services or Content.
The User acknowledges that he/she uses the platform, Services and Content under his/her sole responsibility and at his/her own risk.
Article 8. Modification and termination
The platform reserves the right to modify, suspend or interrupt the platform, the Services, or the Content, in whole or in part, at any time and without notice, for technical, maintenance, security or force majeure reasons. The platform also reserves the right to modify these terms of use at any time and without notice, by publishing the new version on the platform.
The User is invited to consult the conditions of use regularly to take note of any modifications. Use of the platform after modification of the conditions of use constitutes acceptance of the new conditions of use by the User.
The User may terminate his/her Account at any time by contacting the platform at the following address: contact@eagleyardtraining.com. Termination entails deletion of the User’s Account and personal data, and cessation of access to the Services and Content. The platform may also terminate the User’s Account at any time, without notice or compensation, in the event of a breach of the present terms of use.
Article 9. Applicable law and disputes
These terms of use are governed by Canadian law. In the event of a dispute concerning the interpretation, performance, or validity of these terms of use, the parties will endeavor to resolve it amicably. Failing amicable settlement, the dispute shall be submitted to the competent courts of Canada.

The Platform is not intended for or directed to children under the age of 13, and we do not knowingly collect or solicit personal information from children under the age of 13. If we become aware that we have collected personal information from a child under the age of 13, we will delete it as soon as possible. We may update this Privacy Policy from time to time to reflect changes in our practices, the Platform, or the applicable laws and regulations.
